By using this website, submitting an inquiry, approving a proposal, paying an invoice, or engaging Kre8ive Touch Design Studio for services, you agree to the following Terms & Conditions.
1. Project Scope
Kre8ive Touch Design Studio provides branding, design, marketing, web, copywriting, consulting, strategy, and related creative services as outlined in each approved proposal, invoice, email agreement, or other written communication.
Each project includes only what is specifically listed in the approved scope. Any additional work, including but not limited to extra concepts, edits, formats, consultations, research, copy changes, implementation, or support, may be billed separately at our hourly rate or quoted as an additional phase.
2. Acceptance of Terms
A project is considered accepted and scheduled once the Client has approved a proposal or agreement in writing, submitted payment, or otherwise authorized work to begin.
By moving forward with a project, the Client agrees to these Terms & Conditions in full.
3. Scheduling, Availability & Timeline
Estimated timelines are based on current availability and on the timely receipt of all required payments, materials, content, approvals, and communication.
Any timeline discussed before a required deposit or payment is received is tentative and not guaranteed. Project dates and availability are not held until the required payment has been received.
Once a project is underway, meeting agreed deadlines depends on the timely receipt of all requested materials, feedback, approvals, logins, and other required items. Delays in receiving these may affect the schedule.
If timing shifts due to client delays, incomplete materials, scope changes, scheduling conflicts, third-party delays, technical issues, or circumstances outside our control, Kre8ive Touch Design Studio may adjust the timeline accordingly.
4. Client Responsibilities
To help the project move smoothly and stay on track, the Client agrees to:
- provide complete and accurate materials, content, information, and approvals in a timely manner,
- review deliverables promptly,
- respond to requests for feedback or outstanding items within the requested timeframe,
- designate one main point of contact unless otherwise agreed,
- and carefully review all proofs, drafts, and final deliverables before approval.
The Client is also responsible for ensuring that all submitted materials are accurate, properly licensed, and legally usable.
5. Project Contact
Unless otherwise agreed in writing, feedback, approvals, and revision requests should come through one designated point of contact.
We are not responsible for delays, confusion, or additional revision time caused by conflicting feedback, multiple decision-makers, or internal client-side miscommunication.
6. Revisions
Unless otherwise stated in writing, most projects include two rounds of revisions.
A revision round means one reasonably consolidated set of edits submitted together after a draft or deliverable is presented. Multiple scattered emails, piecemeal edits, repeated small changes, or ongoing new requests may be treated as additional rounds or billed separately.
Revisions are intended to refine the agreed direction, not to restart the project, introduce an entirely new concept, or substantially change the scope, content, messaging, layout, or deliverables after work has begun.
Additional revisions, post-approval edits, post-delivery changes, or requests made after a project has been closed may be billed separately at our hourly rate or quoted as a new phase.
7. Scope Changes
Projects are developed based on the information, direction, content, and materials provided at the start of the engagement.
If the direction changes, the scope expands, or new deliverables are added after work begins, this may require an updated timeline, revised proposal, or additional billing at our hourly rate.
8. Rush Requests
Rush work is subject to availability and is not guaranteed.
Requests that require accelerated turnaround, after-hours work, weekend work, reshuffling the schedule, or delivery on compressed notice may incur a rush fee, be billed differently, or require approval under an updated scope.
Rush pricing and availability are determined case by case based on scope, timing, and the nature of the request.
9. Payment Terms
Payment terms will be outlined in the applicable proposal, invoice, or agreement.
A deposit is required to reserve a project in our schedule. No work will begin, and no timeline will be guaranteed, until the required deposit has been received.
We accept payment by:
- Zelle
- ACH / eCheck
- Credit Card
- Debit Card
Please note that credit card payments may be subject to a surcharge not greater than our cost of acceptance, where permitted by law.
Invoices must be paid by the due date listed. If a balance becomes overdue, we may pause work, reschedule deliverables, withhold final files, delay launch, delay transfer or handoff, or otherwise pause project progress until the account is brought current.
Late or missed payments may also affect scheduling and may result in the project being removed from the production calendar.
10. Deposits, Cancellations & Refunds
Because project space, planning time, and creative labor are reserved in advance, all deposits and payments made are non-refundable unless otherwise stated in writing.
If a project is canceled, paused for an extended period, or unable to move forward due to missing communication, materials, approvals, or other client-side delays, no refund will be issued for payments already made. The Client remains responsible for any outstanding balance related to work completed, time reserved, or costs already incurred.
Kre8ive Touch Design Studio reserves the right to decline, pause, or terminate a project for nonpayment, non-responsiveness, abusive conduct, repeated scope overages, or breach of these Terms. In such cases, amounts already paid remain non-refundable.
11. Paused Projects, Inactivity & Archiving
If the Client does not respond, submit required materials, or provide feedback within 14 calendar days, the project may be placed on pause.
If inactivity continues for 30 calendar days, the project may be archived.
Paused or archived projects are resumed on an as-available basis and may be subject to an updated timeline, updated pricing, and/or a restart fee.
Once a project has been paused or archived, original deadlines, scheduling, and availability are no longer guaranteed.
12. Communication & Availability
Project communication is primarily handled by email unless otherwise agreed in writing.
We respond to emails within 2 business days. Additional phone support beyond what is specifically included in the project scope must be scheduled in advance. Brief calls may be accommodated based on availability, while longer calls, strategy calls, or additional meetings may be billed at our hourly rate or quoted separately.
13. Meetings & Consultation Time
Projects include only the calls, meetings, or consultation time specifically listed in the approved scope.
Any additional meetings, extended calls, unscheduled support, strategy discussions, in-person meetings, or consultation time beyond what is included may be billed separately at our hourly rate or quoted in advance.
14. Final Files, Launch & Handoff
Final files, editable deliverables, website launch, transfer, migration, publishing, handoff, or release of completed work will take place only after all outstanding balances have been paid in full.
Unless otherwise stated in writing, deliverables include final approved output files only. Open/native files, source files, layered working files, editable setup files, development files, internal documents, and production files are not included unless they are specifically listed in the approved proposal or purchased separately.
Any requested source or native files must be expressly included in the project scope. If they are not specifically listed, they are excluded by default.
If open/native files are requested and available, they may be provided at an additional fee.
15. Website Projects
For website-related projects, the Client is responsible for providing timely access to any needed platforms, hosting accounts, domains, plugins, themes, content systems, third-party tools, and technical credentials.
Kre8ive Touch Design Studio is not responsible for delays, incompatibility, downtime, breakage, or added work caused by existing website conditions, outdated software, third-party plugins or themes, platform restrictions, hosting issues, domain issues, client-side edits, or outside developers.
Unless otherwise stated in writing, ongoing maintenance, plugin updates, bug monitoring, backups, security monitoring, troubleshooting, content entry, or post-launch support are not included after launch.
Any post-launch fixes related to third-party tools, client edits, software changes, or platform updates may be billed separately.
16. Proofing, Accuracy & Final Approval
The Client is responsible for thoroughly reviewing and approving all content and deliverables before final approval and release.
This includes, but is not limited to, spelling, grammar, names, dates, pricing, phone numbers, email addresses, links, disclaimers, and factual accuracy.
Once approval is given, Kre8ive Touch Design Studio is not responsible for errors, omissions, or issues contained in approved materials.
17. Print & Production
Kre8ive Touch Design Studio is not responsible for printer errors, vendor mistakes, production defects, shipping issues, stock differences, print quality issues, finishing issues, color variation, or other third-party production outcomes once final files or proofs have been approved by the Client.
Colors may appear differently across screens, printers, materials, and production methods. Minor variation is normal and does not constitute an error on our part.
18. Marketing, Advertising & Third-Party Placements
For marketing, advertising, media placement, or publication-related services, Kre8ive Touch Design Studio is not responsible for third-party publication errors, missed placements, scheduling errors by publishers, rejected ads, platform outages, algorithm changes, delivery failures, ad account issues, traffic fluctuations, lead quality, or campaign performance caused by factors outside our control.
While we bring strategy and care to every project, we do not guarantee specific results, impressions, conversions, sales, approvals, or platform performance.
19. Copyright & Intellectual Property
All concepts, drafts, strategy, designs, and creative work remain the property of Kre8ive Touch Design Studio until full payment has been received.
Upon full and final payment, ownership of the final approved deliverables created specifically for the Client transfers to the Client, unless otherwise stated in writing.
Kre8ive Touch Design Studio retains ownership of all preliminary concepts not selected, source files unless included, internal processes, templates, methods, systems, know-how, and any pre-existing intellectual property used in creating the work.
20. Portfolio Rights & Confidentiality
Kre8ive Touch Design Studio may display completed work in our portfolio, website, social media, proposals, presentations, and marketing materials unless otherwise agreed in writing.
At the same time, we treat confidential business information with reasonable care and will not knowingly share sensitive internal information, proprietary business details, or private materials that should reasonably remain confidential.
21. Third-Party Licenses & Services
Unless otherwise stated in writing, the Client is responsible for the cost, purchase, licensing, renewal, and maintenance of any third-party items related to the project, including fonts, stock assets, domains, hosting, plugins, software, apps, integrations, ad spend, printing, and external services.
Kre8ive Touch Design Studio is not responsible for pricing changes, service interruptions, discontinued tools, or policy changes made by third-party providers.
22. Limitation of Liability
To the fullest extent permitted by law, Kre8ive Touch Design Studio shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, business opportunity, data, reputation, or anticipated savings.
Our total liability for any claim arising out of or relating to our services shall not exceed the total amount paid by the Client for the specific service giving rise to the claim.
23. Force Majeure
Kre8ive Touch Design Studio shall not be liable for delays or failure to perform due to circumstances beyond our reasonable control, including but not limited to illness, emergency, internet or software outages, acts of G-d, natural disaster, war, civil unrest, labor disruptions, government action, terrorism, or third-party service failure.
24. Governing Terms
Any dispute arising from these Terms or from services provided by Kre8ive Touch Design Studio shall first be addressed in good faith through direct communication between the parties.
If a separate written agreement governs the project, that agreement shall control. If no separate written agreement applies, disputes shall be governed by the applicable laws of the State of New Jersey.
25. Website Use
All content on this website, including text, branding, graphics, downloads, and visuals, is the property of Kre8ive Touch Design Studio unless otherwise stated.
You may not copy, reproduce, republish, modify, distribute, scrape, or use website content without prior written permission.
You agree not to misuse this website, submit false information, interfere with its functionality, or use it for unlawful purposes.
26. Updates to These Terms
Kre8ive Touch Design Studio may update these Terms & Conditions at any time. Updated terms become effective once posted to this website.
Continued use of the website or continued engagement with our services constitutes acceptance of the updated Terms.
